Terms and Conditions

Welcome to Poach! These Terms and Conditions (“Terms”) govern your access to and use of the Poach Recipes mobile application (“the App”) and the associated website, poachapp.com (“the Website”). By using the App or Website, you agree to comply with these Terms. If you do not agree, you must stop using the App and Website immediately.

These Terms are issued by Poach Apps Ltd, a company registered in the United Kingdom.

1. About Poach

Poach allows users to save and organize recipes from across the web for personal use. The App is intended for lawful and personal purposes only.

2. Your Agreement

By using Poach, you confirm that:

• You have the legal capacity to enter into this agreement, meaning you are at least 18 years old or, if under 18, you have obtained the consent of a parent or legal guardian.
• You will use Poach in compliance with these Terms, all applicable laws, and regulations, including those relating to copyright and intellectual property.
• You are responsible for any activity carried out under your account.

3. Prohibited Uses

You agree not to use Poach for the following:

• Copyright Infringement: Using Poach to save, store, or share copyrighted content without the necessary permissions or in violation of applicable copyright laws. Users must ensure they have the right to save and use any content added to the App.
• Commercial Use: Using Poach for commercial purposes, such as redistributing recipes or other content for profit.
• Harmful Activities: Engaging in unlawful, fraudulent, or abusive activities, including attempting to hack, disable, or interfere with the App or Website.
• Violation of Rights: Uploading or saving content that violates the intellectual property, privacy, or other rights of third parties.

Poach Apps Ltd reserves the right to monitor usage and take action (including account suspension or termination) if prohibited activities are detected.

4. Copyright and Intellectual Property

• Respect for Copyright: Recipes, text, images, or any other materials sourced from third-party websites remain the intellectual property of their respective owners. Poach does not claim ownership of content saved by users.

• Poach as a Tool: Poach Apps Ltd acts solely as a tool for organizing user-sourced content and does not facilitate or encourage copyright infringement. Users must ensure they have the right to save and use third-party content through the App. See also Section 3 on prohibited uses and Section 8 regarding third-party websites.

• Your Responsibility: Poach Apps Ltd does not monitor the legality of content saved by users. You are solely responsible for ensuring compliance with copyright laws and obtaining any necessary permissions for saved content.

• Ownership of the App: The Poach mobile application, website (poachapp.com), and all associated trademarks, logos, software, and designs are the exclusive property of Poach Apps Ltd or its licensors. You may not copy, modify, or distribute these elements without express written permission from Poach Apps Ltd. This excludes any third-party content that you save using the App, which remains the property of its original owners.

5. Subscriptions and In-App Purchases

• Poach may offer subscriptions or other in-app purchases powered by Apple.
• Payment and Billing: Payments are managed through your Apple ID account and are subject to Apple’s terms and conditions.
• Auto-Renewal: Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage subscriptions through your Apple ID account settings.
• Refunds: All refunds for in-app purchases are subject to Apple’s refund policies.

6. Privacy

• Data Protection: Poach Apps Ltd complies with the UK General Data Protection Regulation (UK GDPR), the EU GDPR, and other relevant privacy laws, including the California Consumer Privacy Act (CCPA) for users in the United States.
• Data Collection: By using the App, you agree to the collection and processing of personal data as outlined in our Privacy Policy.
• Your Rights:
  • Under GDPR, you have the right to access, correct, delete, or restrict the use of your personal data.
  • Under CCPA, California residents have the right to know what data is collected, request deletion, and opt out of the sale of personal data (Poach does not sell personal data).
  • Requests related to your data can be submitted by contacting us at support@poachapp.com.

7. Limitation of Liability

• The App and Website are provided “as is” without any guarantees or warranties, express or implied.
• To the fullest extent permitted by UK law, Poach Apps Ltd is not liable for any loss or damage (direct, indirect, incidental, or consequential) arising from:
  • Your use of or inability to use the App or Website.
  • The accuracy, legality, or reliability of content saved through Poach.
  • Unauthorized access to your account or data.

• In no event will Poach Apps Ltd's total liability exceed the greater of:

  £100 (GBP); or

  The total amount paid by you for subscriptions or in-app purchases in the 12 months preceding the claim.

• Poach Apps Ltd is not liable for any disputes arising from the saving or use of third-party content, including copyright infringement claims. Users are solely responsible for ensuring their use of content complies with applicable laws. Refer to Section 4 for more details on copyright responsibility.

• Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

  • Any other liability that cannot be excluded by law.

8. Third-Party Websites

You are solely responsible for ensuring that your use of content from third-party websites complies with their respective terms of service, privacy policies, and copyright regulations. Poach Apps Ltd is not responsible for the legality or availability of third-party content. See also Section 4 regarding copyright and intellectual property.

9. Termination

We reserve the right to terminate or suspend your access to Poach at any time, with or without notice, if you violate these Terms or if we believe your use of the App poses a risk to us or other users.

10. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales. Users from outside the UK are responsible for ensuring compliance with local laws while using the App.

11. Updates to These Terms

We may update these Terms from time to time. Updated versions will be posted on the Website or within the App. Continued use of Poach after updates signifies your acceptance of the revised Terms.
